Levenbach advocaten hosts international labour law conference in Amsterdam10/07/2013
On 28 June of this year our office hosted a conference at the Double Tree Hilton Hotel in Amsterdam for a group op labour law specialists from all over Europe. Like our firm, the participating firms are all members of LawExchange International, an association of top law firms serving clients in commercial markets worldwide. Within their own jurisdiction, each firm represents corporations that operate on a global scale. Auke de Vries, partner at Levenbach advocaten, is the current chairman of this worldwide organization. Spain, Italy, Denmark, Germany, Sweden, Belgium, Portugal and Great Britain amongst others were represented at this international labour law conference.
The goal of this conference was to exchange regional and international case law and to discuss international issues within labour law, which are of relevance for each other’s mutual international clients. This interesting day strengthened the existing working relations between the labour law specialists from the various European jurisdictions. This contributes to our ability to offer our clients full legal services in cross border matters.
Fruitful friendship between Levenbach and Nudge14/05/2013

More legal procedures due to the Dutch Copyright Contracts Bill?12/10/2012
There has been quite some commotion about the Copyright Contracts Bill that was presented in the Dutch Parliament on 19 June 2012. The main goal of the Bill is to strengthen the legal position of authors and performing artists in respect to production companies. Film producers in particular fear that the Bill will lead to an increase in the amount of legal procedures due to the vague and abstract definitions that are included in the Bill, such as ‘reasonable compensation’ and ‘proportional reasonable compensation’.
Although the Bill indeed contains some vague and abstract terms, this does not necessarily mean that the Bill is faulty. As contracts are often customized to the specific circumstances of the case, it is therefore not desirable to include specific (minimum) numbers or percentages that contract parties should agree to. Besides, this could also lead to an increase of legal conflicts. A (temporary) increase in legal procedures might be an inevitable consequence in order to restore the legal ‘unbalance’ between authors, performing artists and producers. Since many authors and performing artists are now reluctant to start court proceedings, the Bill also provides for an efficient and accessible Dispute Committee, where Associations for authors and performing artists may also submit complaints. This could solve the problem. However, the real fear of producers may not be an increase in legal procedures, but an increase in payments to authors.
It is a noble thought that the Dutch government wants to protect the ‘weaker’ contract party against the more ‘powerful’ producers by means of legislation. However, it remains questionable if authors will actually make use of such legislation, if the balance is still not fully restored.
Considerable increase in costs for expert opinion from the UWV12/10/2012
Starting from January 1st 2013 the costs for an expert opinion from the UWV (regional labor office) will increase considerably. The fees for an expert opinion are now 50 euros for both employees and employers, but next year the costs will be 175 euros for the employee and 350 euros for the employer.
